IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 939 WRIT PETITION NO. 4377 OF 2026 MHAISEWAD ROHIT SHEKAR ....Petitioner
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS SECRETARY AND ORS .....Respondents .....
Advocate for the Petitioner : Mr. Jayewar Sainath Gangadhar AGP for Respondent/State: Mr. S. P. Sonpawale Advocate for Respondent No.3 : Adv. Mayuri .G. Kasturkar .....
CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.
DATED : APRIL 22, 2026 ORAL ORDER (PER ABASAHEB D. SHINDE, J):- 1.
Heard learned counsel for the petitioner and learned A.G.P. and learned counsel appearing on behalf of respondent No.3. 2.
By this Writ Petition, the petitioner is seeking direction for expeditious disposal of his tribe claim of belonging to 'Mannervarlu" Scheduled Tribe which is pending before the respondent No.2/ Scrutiny Committee since 03.02.2026.
3.
The learned counsel for the petitioner submits that the petitioner has been appointed on the post of Daksevak vide appointment order dated 23.03.2026 by respondent No.3. While
(2) 939- W. P. 4377-2026.odt issuing appointment order, the respondent No.3 has obtained undertaking from the petitioner to the effect that the petitioner shall submit the tribe validity certificate within a period of two months. The apprehension of the petitioner is that, by virtue of the said undertaking, the services of the petitioner would be brought to an end by respondent No.3.
4.
We find that the petitioner cannot be faulted with, since when the Scrutiny Committee would decide his tribe claim is not in his hands. The learned counsel for respondent No.3 makes a statement that the said period of two months directing the petitioner to submit the tribe validity certificate would be extended by further period of four months.
5.
In that view of the matter, we direct the respondent/Scrutiny Committee to decide the tribe claim of the petitioner as expeditiously as possible and in any case by the end of August 2026. 6.
With this direction, the Writ Petition stands disposed of. (ABASAHEB D. SHINDE) (SANDIPKUMAR C. MORE) JUDGE JUDGE YSK/
