IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO. 4388 OF 2026 Roshanbi Banekhan Pathan
VERSUS
The State Of Maharashtra Thr. Its Principal Secretary And Ors. ...
Mr. K. N. Shermale, Advocate for the Petitioner Mr. S. D. Ghayal, AGP for Respondents *** CORAM : S. G. CHAPALGAONKAR, J DATE : APRIL 22, 2026 PC :
1.
The present Writ Petition takes exception to order dated 25.02.2026 passed by learned Tahsildar, Ahilyanagar in Kra.Kavi/Darkhat/Case No. 10/2019. 2.
The perusal of order shows that in pursuance to precepts under Section 54 of Code of Civil Procedure execution of decree was undertaken. The Tahsildar has prepared distribution chart (okVi rDrk) and same has been approved for final execution of decree. The impugned order itself indicates that if any party is not in agreement with distribution shown, he has remedy of filing appeal before Sub-Divisional Officer.
3.
In that view of matter, this Court do not find any reason to entertain Writ Petition. Hence, Writ Petition stands rejected. Petitioner shall be at liberty to take up appropriate remedy as indicated in impugned order. 4.
At this stage, Mr. Shermale, learned Advocate appearing for Petitioner,
930-WP-4388-2026.odt submits that effect of distribution of okVi rDrk be kept in abeyance so that Petitioner can take up alternate remedy.
5.
In view of this submission, effect of impugned order shall be kept in abeyance for a period of two weeks from today. (S. G. CHAPALGAONKAR, J.) Umesh
