The petitioner, an auction purchaser, is constrained to approach the Debt Recovery Tribunal - II, Mumbai (DRT) to challenge a notice of forfeiture of 25% of deposit, by the respondent No.2 Bank. It is submitted that although the Securitisation Application No.186 of 2025 along with an interim application was filed on behalf of the petitioner as far back as on 21.02.2025, till date, there is hardly any progress before the DRT. Respondent No.2 Bank has not filed its reply in the said application and the next date before the DRT is 28.04.2026. 2.

Since the petitioner is seeking limited relief of direction to the DRT to dispose of the pending application in a time bound manner, we are inclined to dispose of this petition, as such a direction is in the MINAL SANDIP PARAB by MINAL SANDIP PARAB Date: 2026.04.09 15:38:15 +0530 interest of all the concerned parties.

In the facts and circumstances of the present case, the DRT is directed to ensure that the respondent No.2 Bank files its reply affidavit in the pending securitisation application as well as the interim 1/2

17_WP4390_26.doc application at the earliest. On the next date of listing i.e. 28.04.2026, the DRT may grant further time only of two weeks and no more to the respondent No.2 Bank to file its reply affidavit to which the petitioner may file its rejoinder affidavit within a week thereafter. 4.

The DRT shall take up the pending application expeditiously and dispose of the same at the earliest possible and in any case, on or before 30.06.2026.

The petition is disposed of accordingly.
