Present petition takes exception to order dated 04.02.2026 passed by Civil Judge Senior Division, Jalgaon below Exhibit-22 in H.M.P. No.233 of 2025, whereby respondent/wife is granted maintenance of Rs.10,000/- per month in exercise of powers conferred under Section 24 of Hindu Marriage Act. 2.

Learned advocate appearing for petitioner raises two exceptions to impugned order. Firstly, he would submit that considering language of Section 24 of Hindu Marriage Act, only expenses can be granted and there is no provision for grant of maintenance. Secondly, he would submit that maintenance awarded is excessive and exorbitant. Section 24 of Hindu Marriage Act has been brought in statute with specific object to provide maintenance as well as expenses to spouse, who is driven in litigation. It is no more res integra that Courts are having powers to grant maintenance as well as expenses. The second contention that maintenance amount of

1008-wp-4479-2026.odt (2) Rs.10,000/- is excessive and exorbitant cannot be countenanced for the reason that applicant is Police Havaldar and earning around Rs.80,000/- per month. There is no dispute as to aforesaid said issue. The amount of Rs.10,000/- cannot be said to be excessive and exorbitant considering family status of petitioner and respondent/wife.

In result, this Court do not find any reason to interfere in impugned order in exercise of writ jurisdiction. Hence, writ petition stands dismissed.
