The challenge in this petition arises out of an order passed by the Revisional Authority, before whom the petitioner had challenged the notice of auction.

Apart from the said notice, all other notices pertaining to the auction proceedings were also brought under challenge. 3.
This Court, in several judgments, including Dattatraya Mahadev Ugale & Ors. vs. The State of Maharashtra & Ors. (Writ Petition No. 3500 of 2024, decided on 10 May 2024), has held that a notice of auction issued by a cooperative society does not amount to a "decision or order" amenable to revision under Section 154 of the Maharashtra Cooperative Societies Act, 1960. It has been clarified that the revisional jurisdiction under Section 154
902-wp-4537-2026.doc is confined to final quasi-judicial decisions. If a party is aggrieved by any action falling within the scope of a "decision or order," it is open to such party to challenge the same, including any order passed by the Special Recovery Officer under Rule 107 of the Maharashtra Cooperative Societies Rules, 1961, in accordance with law.

Hence, keeping all contentions of the petitioner open to be agitated in appropriate proceedings, the present petition, being based on a revision which is itself not maintainable, cannot be entertained.

Accordingly, the writ petition stands dismissed. (AMIT BORKAR, J.)
