ORDER :

By this Writ Petition, the Petitioner - School is seeking release of entire amount payable to the Petitioner - School towards re-imbursement of fees against students admitted by the Petitioner under the RTE Act.

Having heard the learned Counsel appearing for the KAVITA SUSHIL JADHAV parties and perusing prior orders passed by this Court, including the by KAVITA SUSHIL JADHAV Date: 2026.04.21 13:09:10 +0530 Order dated 9th April, 2025 in Modern English Medium School, 1/3
Naitale Vs. The State of Maharashtra, through School Education and Sport Department and Ors. in Writ Petition No.4518 of 2026, which in turn has relied upon Order dated 7th April, 2026 in Sarvodaya English Primary School Trust Vs. State of Maharashtra through the School Education and Sports Department and Ors. in Writ Petition (L) No.41723 of 2025, we pass similar order as under: (i) The Respondent No.1 - State shall within a period of 12 weeks from the date of this order, scrutinize the case of the Petitioner - School and determine the eligibility as well as quantum of reimbursement to the Petitioner - School. (ii) The admissible amount of reimbursement to the Petitioner - School shall be released by the Respondent - State within a period of two weeks from such determination.
(iii) In the event the Petitioner - School is not entitled for any amount of reimbursement, a reasoned order to that effect shall be passed and the Petitioner - School shall be at liberty to seek redressal of his grievance, in accordance with law.

Writ Petition is disposed of in above terms. There shall be no order as to costs.
