The Petitioner is the biological mother of a child. She wants to travel for personal and educational purpose. The child is 2 years and 9 months old. It is informed that it is wrongly mentioned in the cause-title that the child who is 2 years and 9 months old, is already taking education.

The biological mother of the child wants to travel to London on 31/05/2026. An Application (Exhibit-16) dated

22/01/2025 is already filed and pending before the Family Court at Kalyan (earlier the matter was before the Family Court at Pune bearing Petition A No.1426 of 2024, which is now transferred to the Family Court in Kalyan) bearing Petition A No.1500 of 2025. Exhibit-16 is filed for the purpose of getting a direction to the biological father to give his NOC for the Passport and VISA of the child.

Since the Application (Exhibit-16) is already pending before the Competent Court, we do not deem it appropriate to commence a hearing in the Writ Petition in the same cause. Moreover, we would have to issue notice to the natural father and considering the vacations, we would have to give him time to file a reply and respond. Instead, it would be appropriate to direct the learned Family Court, Kalyan where the parties have already appeared, to prepone the date of hearing on Exhibit-16 and pass appropriate orders considering the urgency expressed by the Petitioner.

As such, this Petition is disposed off. We would appreciate if the learned Family Court, Kalyan prepones the hearing in Petition A No.1500 of 2025, for a hearing on Application

(Exhibit-16) urgently and ensure that urgent orders are passed in the matter to enable the biological mother to approach authorities for the Aadhaar Card and the Passport.
