ORDER :

Having heard the learned Counsel for the parties on the present Writ Petition and considering that on the same day of closing of the matter for orders, the Petitioner had addressed a communication requesting for adjournment and for issuing instructions for the Enforcement Officer ("EO") to provide copy of compilation of Form 11 to the Petitioner in the interest of justice. KAVITA SUSHIL JADHAV Further, the Petitioner by subsequent Correspondence dated 27th by KAVITA SUSHIL JADHAV Date: 2026.04.30 11:03:28 +0530 November, 2025 had stated that due to unexpected delay in traffic, 1/3
the Petitioner was unable to attend on the scheduled date of hearing i.e. on 19th November, 2025 when the matter had been kept for submission of table showing Form 11 records from EO. Accordingly, we are inclined to set aside the impugned order to the limited extent of non consideration of the Petitioner's submission with regard to verification of Form 11 submitted by the establishment. We have not expressed any opinion on the merits of the present Petition insofar as this issue is concerned. Further, the impugned order insofar as other issues are concerned have not been interfered with on merits. 2.
The Petitioner is at liberty to make a representation insofar as the aforementioned issue is concerned and which representation shall be decided by the Respondent No.1 on merits after hearing of the Petitioner, within a period of four weeks from the filing of the representation and which shall be filed, within a period of one week from today.

The fresh order passed in respect of the aforementioned issue shall form part of the Order dated 2nd March, 2026 and necessary adjustment, if held to be made, shall be made accordingly. 4.
In the event the Petitioner is aggrieved by the fresh 2/3
order, the Appeal lies before the CGIT, which the Petitioner shall avail of.

The Writ Petition is disposed of in these terms. There shall be no orders as to costs.
