Present writ petition takes exception to the order dated 8.1.2026 passed by learned Civil Judge S.D. Bhokar, District Nanded below Exhibit-18 in H.M.P. No.13 of 2024. 2.

Petitioner filed proceeding for decree of dissolution of marriage against respondent/wife on the ground of cruelty. The respondent/wife appeared in response to the suit summons, filed her written statement and an application Exhibit-18 under section 24 of the Hindu Marriage Act for grant of interim maintenance @ Rs.15,000/- p.m. and expenses of Rs.500/-. Application was opposed by petitioner on the ground that he does not have source of income, by which he can pay maintenance to respondent/wife.

Trial Court, after considering rival contentions, observed that, respondent/wife is maintaining two children aged about 5 and 3 years. She do not have source of income. Petitioner holds agricultural land, however, he did not disclose exact income generated from cultivation of land. In the affidavit filed by petitioner below Exhibit-23, he has mentioned source of income like pension, house rent and savings in bank, however, details of same are not specified. In this background, Trial Court estimated probable income of petitioner @ Rs.25,000/-p.m. from all sources. Eventually, granted maintenance of Rs.8,000/- p.m. to respondent wife, who has taken responsibility to maintain son and daughter namely Priyal and Rajveer. This court finds that assessment of maintenance of Rs.8,000/- p.m. cannot be said to be excessive and exorbitant. No other ground is put into service to assail order granting interim maintenance.

In that view of the matter, this Court finds no merit in the writ petition. Writ Petition stands rejected. ( S. G. CHAPALGAONKAR, J. ) ...
