Present petition has been filed for following reliefs : "B.

The issuing Writ of Mandamus or any other appropriate Writ, order or directions in like nature the Respondent no. 2 may kindly be directed pay the amount of compensation to the petitioner in accordance with the Supplementary Award bearing No. 2016/Bhusa./NH-361/CR-2 dated 11.11.2020 (referred as dated 10.11.2020) passed by the Respondent No.3 at the earliest.

The issuing Writ of Mandamus or any other appropriate Writ, order or directions in like nature, direct the Arbitrator National Highway / District Collector, Hingoli to decide the arbitration proceedings in respect of Supplementary Award dated 11.11.2020 (referred as dated 10.11.2020) bearing No. 2016/Bhusa./NH-361/CR-2 at the earliest."

Heard learned Advocate for the petitioner. It appears that arbitration proceedings are pending in respect of the supplementary award

( 2 ) 927 WP 5060 OF 2026 dated 11.11.2020. Under such circumstance, the prayer clause "B" cannot be directed because it is the award which is under challenge before the Arbitrator. Therefore, we have considered only prayer clause "C". 3.

Upon our instructions, learned AGP has taken instructions from the District Collector, Hingoli before whom the arbitration proceedings are pending as per the National Highway / District Collector, Hingoli. No doubt, the petitioner has not made the District Collector a party in the capacity as Arbitrator, but he has been made a party as District Collector of the State Government. Yet, it is the same person, having different nomenclature or designation, who has to take the decision in the capacity as Arbitrator. Upon instructions, learned AGP makes a statement that the arbitration proceedings would be concluded within four months from today. The said statement is taken as undertaking.

We dispose of the writ petition by directing the Arbitrator / District Collector, Hingoli to decide the arbitration proceeding in respect of Supplementary Award dated 11.11.2020 (referred as dated 10.11.2020) bearing No. 2016/Bhusa./NH-361/CR-2 within a period of four months from today.
