Heard learned Advocate for the petitioner and learned AGP for respondent Nos.1 to 5.

The petitioner is admittedly a government servant and seeks directions against respondent Nos.1 and 2 to release the monetary benefits by treating him under regular transfer to Kolhapur prison. He is also claiming compensation for mental agony and suffering because of illegal transfer, thereby challenging his transfer orders also and therefore, at the first breath, he should approach Maharashtra Administrative Tribunal. When these observations are made, the learned Advocate for the petitioner, upon instructions, seeks withdrawal of the petition to approach the Tribunal.
