After disinclination, the learned Advocate for the petitioner, upon instructions, seeks withdrawal of the petition to approach the Civil Court. 2.

Here, it is to be noted that the petitioner is relying upon the photographs and contending that initially the road was to go from his land, however, the farmer from the other side had then asked the authorities to construct the road from his side and accordingly, the authorities have started constructing the road from his land to the extent of 6 feet in width. We are of the opinion that the matter has disputed questions of facts and therefore, they cannot be gone into in the writ jurisdiction of this Court and therefore, the disinclination was shown.

However, now, when upon instructions, learned Advocate for the petitioner seeks withdrawal of the petition with liberty, we grant the same. 4.
