**** CORAM : RAVINDRA V. GHUGE AND HITEN S. VENEGAVKAR, JJ.
DATE : 28th APRIL, 2026 P.C. :
1.
A large group of cases has been closed for judgment after all the parties concluded their oral submissions and tendered written notes of arguments.
2.
These Petitions before us have been transferred to this Bench under the order of the Hon'ble The Chief Justice of the Bombay High Court.
3.
In all the matters closed for judgment, ad-interim protection has been granted to the Petitioners. The ad-interim relief was in the following nature :- (a) All the Petitioners would subject themselves for a medical re-examination without any objection on opposition, as per the time schedule fixed by the employer.
(b) Whatever may be the medical report pursuant to such medical examination, none of the employers would initiate precipitative or adverse action against such Petitioners. (c) In cases where such Petitioners have been suspended pursuant to the medical reports generated on fresh medical reexamination, this Court has stayed such suspension orders. 4.
In view of the above, the same directions passed in other matters as reproduced above, would be equally applicable by way of adinterim relief in all these cases. Their suspension orders shall stand stayed. They would continue to perform their duties and draw their wages subject to none of them skipping or avoiding any medical examination.
5.
List these Petitions on 7th May, 2026 in the urgent supplementary board.
