All the petitioners in this Petition are working as Professors in private aided college namely Rashtramata Indira Gandhi Arts, Commerce and Science College, Jalna.

By communication dated 27.03.2026, respondent no.4 has appointed the petitioners as Enumerators/Supervisors. They were asked to join training programme during 27.04.2026 to 08.05.2026, which they have attended. Further now from 16.05.2026 to 14.06.2026, the petitioners have to participate in the phase-I of census. 3.
Petitioners are also assigned with the duty of assessment of answer-books by the Custodian D-CAS of Dr. Babasaheb Ambedkar Marathwada University, Aurangabad, by letter dated 05.05.2026, failing ksk/ 1/2
914 WRIT PETITION NO. 5191 OF 2026 which it will be treated as misconduct and the petitioners shall be liable for disciplinary action.

By relying on the interim order passed by Nagpur Bench in Writ Petition No. 3004 of 2026 [Coram : Anil L. Pansare and Nivedita P. Mehta, JJ.] in The Sikh Education Society Bezon Bagh, Nagpur through its General Secretary and ors. Vs. Union of India, through its Secretary, Department of Home Affairs (MHA), New Delhi and ors. dated 10.04.2026, interim stay is sought.

Heard learned Advocate for the petitioners and learned A.G.P. for the State.

After going through the facts, relevant provisions and order in Writ Petition No. 3004 of 2026 (supra), I am of the considered view that the case is made out for grant of interim relief. 7.
Issue notice to the respondents, returnable on 29.05.2026. Learned A.G.P. waives for respondent nos.2 to 5. 8.
In the meantime, there shall be stay to the order dated 27.03.2026 passed by respondent no.4.
