Mr. Rathi, learned advocate appearing for petitioner submits that recently, Trial Court has already passed order impounding agreement of sale which is subject matter of dispute in suit. The order is communicated to District Collector. The formality of furnishing Challan is in progress. He would further submit that documents which supports petitioner's possession over suit property could not be pleaded in plaint, as copies thereof were not available at the time of institution of suit. Hence, petitioner intends to incorporate necessary amendment in plaint to overcome deficiencies in pleadings. 2.

In that view of matter, Mr. Rathi seeks permission to withdraw present petition with liberty to move afresh before Trial Court for temporary injunction on the basis of additional pleadings and impounded agreement to sale.
