Heard learned counsel for the parties.

The Revision Application No.1066 of 2025 filed by the petitioner against the order of the Tahsildar is pending since 2025. It is the grievance of the learned counsel for the petitioner that the application for stay is not yet heard and decided. It is further submitted that even before the application for stay could be heard and decided, the Tahsildar Bhiwandi is proceeding with the execution of the order and accordingly has issued the notice dated 02.04.2026.

We have gone through the writ petition. We have heard learned AGP who opposed the writ petition and supported the order passed by the Tahsildar. Our attention is invited to the findings of the Tahsildar.

However, we are not inclined to express any opinion on the merits of the respective contentions as the Revision Application is still pending. In the present facts, this writ petition can be disposed of by directing the Additional Commissioner to decide the application for stay preferred in the pending Revision Application within a period of eight weeks from 12/05/2026. The petitioner to appear before the Additional Commissioner on 12/05/2026 at 11:00 a.m. The petitioner to cooperate with the hearing and shall not ask for any unnecessary adjournments. The application to be decided on its own merits and in accordance with law. It is also open for the Additional Commissioner to decide the Revision Application itself within such time if time permits. In the interest of justice for a period of ten weeks from today the notice dated 02.04.2026 issued by the Tahsildar Bhiwandi not to be enforced.

Keeping all contentions open, the writ petition is disposed of.
