Heard the learned Counsel for the parties.

The challenge in this petition is in substance to the very same officer, who has submitted a report to the Director of Marketing, hearing the disqualification proceedings in the capacity of the Incharge Director of Marketing. 3.

Smt. Srivastava, the learned AGP, on instructions submits that, Mr. Sharad Jare the concerned Secretary of the Mumbai Agricultural Produce Market Committee, Mumbai, who had submitted a report to the Director of Marketing on 24th March, 2026, and has also been appointed as Incharge Director of Marketing, by an order dated 07th April, 2026, has addressed a communication to the Government seeking orders to appoint another officer as there is possibility of the conflict of the SAINATH, PA 1/2

3 WP 5269-26.DOC authority. Copy of the said report dated 13th April, 2026 is tendered for the perusal of the Court.

Awaiting the orders that may be passed by the State Government, it is directed that the disqualification proceedings against the petitioners shall be deferred till another Competent Officer is appointed to hear the said proceedings. It is further directed that, in any event, Mr. Sharad Jare, the Incharge Director of Marketing shall not hear the disqualification proceedings initiated against the petitioners. 5.

Subject to the aforesaid directions, the Writ Petition stands disposed.
