IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 5479 OF 2026 Manisha Pamnani and others ...
Petitioners vs.
Yogesh Vasant Satav and others ...
Respondents Mr. Rishabh Shah (through V.C.) a/w. Mr. Anshul Anjarlekar, i/b. Raval-Shah & Co. for petitioners.
Mr. Chetan C. Agrawal a/w. Mr. Rushikesh Bhorania for respondent No.3. CORAM : MANISH PITALE & SHREERAM V. SHIRSAT, JJ DATE :
28th APRIL, 2026 P.C. :
.
This petition is filed by auction purchasers, who are aggrieved by the fact that the securitisation application filed by respondent Nos.1 and 2 is pending consideration before the Debts Recovery Tribunal, Pune (DRT) for considerable period of time, with an order of status quo granted as far back as on 13.08.2024 operating in favour of respondent Nos.1 and 2. An affidavit of service is tendered with regard to the attempts made to serve respondent Nos.1 and 2 through speed post. The said affidavit is taken on record. Respondent No.3 is the secured creditor and it is represented by counsel before this Court.
2.
Although the aforesaid affidavit of service indicates that private notice sent by the petitioners could not be served upon the respondent Nos.1 and 2, considering the limited direction sought in the present petition, we are of the opinion that the petition can be disposed of today itself. We are of the firm opinion that a direction Digitally signed by PRIYA KAMBLI Date:
2026.04.28 18:11:02 +0530 1/2 PRIYA KAMBLI
18_WP_5479_26.doc for expeditious disposal of the pending securitisation application will inure to the benefit of all the parties before the DRT and it is not necessary to await service upon respondent Nos.1 and 2. We also find that order dated 13.08.2024 granting status quo, does not record any reasons for granting the said direction. Pendency of the proceedings before the DRT is obviously detrimental to the petitioners, who are auction purchasers and are suffering interim order of status quo. 3.
We are also informed that the pleadings in the securitisation application and pending interlocutory applications are complete and that appropriate direction can be issued for expeditious disposal of the same.
4.
In view of the above, the writ petition is disposed of by directing the DRT, Pune, to dispose of pending Securitisation Application No.377 of 2024 along with all pending interlocutory applications, as expeditiously as possible and in any case, on or before 31.07.2026.
