ORDER:- 1.

The petitioners impugns order dated 25.05.2026 passed by District Co-operative Election Officer and Divisional Joint Registrar, Co-operative Societies, Latur, thereby directing to delete names of petitioners as delegates of Seva Sahakari Sanstha.

The petitioners contends that they are members of Seva Sahakari Sanstha, who passed Resolution nominating them as delegates at election of Nanded District Central Co-operative Bank (for short 'NDCC Bank'). Their names were included in provisional voters list. However, on objection raised by respondent no.4, respondent no.1 directed to delete petitioners' name from voters list.

Perusal of record tendered into service demonstrates that petitioners and respondent no.4 both are claiming that they have been nominated as delegates under Resolution of Seva Sahakari Sansth. However, both Resolutions are seriously disputed. The Secretary of Society recorded his statement before Assistant Registrar that he had never signed notice of meeting dated 03.04.2026. Similarly, Chairman of Society denied his signature on minutes of meeting dated 09.04.2026. The respondent no.2 observed that signatures on minutes of meeting are manipulated. The respondent no.2 has recorded sufficient reasons to discard nominations under Resolutions dated 09.04.2026 as well as 10.04.2026 alleged to have been passed by Society nominating Mr. Vinod Balaji Torne or Devshala Motiram Torne as delegates of Society.

In light of aforesaid disputed questions of facts, this Court finds that respondent no.2 is justified in directing deletion of name

(3) of Society from final voters list for want of valid and acceptable Resolution appointing delegate. Hence, this Court do not find any good ground to exercise Writ jurisdiction under Article 227 of Constitution of India to cause interference in impugned order. 5.

In result, Writ Petitions stand dismissed.
