Present petition takes exception to order dated 28.05.2026 passed by District Cooperative Election Officer and Divisional Joint Registrar, Cooperative Societies, Chhatrapati Sambhajinagar, whereby petitioner's objection to nomination of respondent no.6 as delegate of respondent no.5 society has been rejected.

The petitioner contends that meeting in which resolution for nominating respondent no.6 as delegate of respondent no.5 society is passed was not conducted in accordance with law. There was no proper service of notice to members of managing committee and even meeting was not conducted at Gram Panchayat office as indicated in notice of meeting.

Perusal of impugned order suggest that resolution is passed by majority of committee members thereby nominating

The contention of petitioner that resolution is not passed in consonance with bye-laws and rules cannot be accepted at this stage. Respondent no.2 has rightly considered relevant aspects within parameters of his jurisdiction under Rule 11 of Maharashtra Co-Operative Societies (Election To Committee) Rules, 2014. If petitioner is aggrieved by validity of resolution, remedy is under Section 91 of Maharashtra Cooperative Societies Act, 1960. 4.

In result, no case is made out to cause interference under Article 227 of Constitution of India. Hence, writ petition stands rejected.
