Heard Mr. Kharosekar learned Advocate for the petitioner. He would submit that the Petitioner's J.C.B. No. MH-17-DC-1405 is seized by the Revenue Authorities under Section 48(8)(2) of the Maharashtra Land Revenue Code. He submits that he has filed appeal before the Appellate Forum and stay is also granted in his appeal. He further submits that he has deposited 25% amount of the penalty in the office of the authorities and has prayed to release the vehicle. That, despite of compliance to the statutory provisions, the authorities have not yet released the vehicle. 2.

By that time, learned Assistant Government Pleader to take instructions as to whether the petitioner has complied the condition precedent for release of the vehicle. Learned Assistant Government Pleader shall also answer on the next date if the petitioner has complied with the mandatory provision for release of his vehicle, why concerned authority has not yet released his vehicle.
