Petitioner is liquidator of Kamla Real Estate Hub Private Limited (Kamla). Petitioner believes that Kamla is entitled to secure possession of the units in question (Unit Nos.3, 4 and 9). The Petitioner believes katkam Page No.

k 2/2 25-27 wp 5564.26 as.doc that Plaintiffs in LE&C Suits filed before Court of Small Causes have secured forceful possession of the units in question. The Plaintiffs have secured eviction decrees against Fashion TV India Private Limited from the Court of Small Causes. Petitioner believes that in execution of the said decrees, the possession of the subject units ought to be delivered to it and not to the Plaintiffs in the Suits. Since licenses were granted by the Plaintiffs, possession will have to be naturally delivered to the Plaintiffs. If Petitioner believes that it is entitled to secure possession from Plaintiffs, Petitioner will have to adopt appropriate proceedings. 2.

Mr. Tamboly, the learned counsel appearing for Petitioner submits that Petitioner has already initiated proceedings in National Company Law Tribunal, Mumbai for securing possession of the units in question from the Plaintiffs. Those proceedings would be decided uninfluenced by any findings recorded in the decrees passed by the Small Causes Court. 3.

Petitioner would also be at liberty to take out such additional proceedings as are deemed appropriate for the purpose of securing possession of units in question from the Plaintiffs. 4.

All contentions of parties are expressly kept open. 5.

Writ Petitions are accordingly disposed of.
