IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.5915 of 2026 SAYALI DEEPAK UPASANI Ashwini Chandrakant Tambokar ... Petitioners V/s.

The Deputy Registrar Co-op Society R North and Others ... Respondents by SAYALI DEEPAK UPASANI Date:

2026.05.04 15:39:43 +0530 Mr. Abhishek Upadyay, for Petitioner.

Ms. S. D. Chipade, AGP for State- Respondent no. 1.

CORAM

: AMIT BORKAR, J.

DATED : MAY 04, 2026 P.C.:

1.

The petitioners claimed to be earlier developer of the society. According to him, the deemed conveyance order passed in favour of the society is subject matter of challenge before the Supreme Court and therefore, the impugned order dated 25th July, 2024, granting no objection to redevelop the building needs to be quashed and set aside.

2.

Apart from the ground of laches, in my opinion, the developer who constructed the building cannot challenge the impugned order granting no objection after a period of almost two years. If the petitioner intends to challenge the

14-WP-5915-26.doc redevelopment process, the petitioner will have to adopt appropriate proceedings as are permissible in law. 3.

With this, the petition cannot be entertained, the petition stands disposed of.
