The Petitioner-Society submits that against the order dated 9th March 2026 passed by the Chief Executive Officer / SRA, Brihanmumbai in the proceeding filed under Section 13(2) of the Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 ("Maharashtra Slum Act, 1971"), the Petitioner has preferred an Appeal No.134 of 2026 before the Apex Grievance Redressal Committee ("AGRC"). It is submitted that the Satish Sangar 1/2

53-WP-6048-2026.doc application for stay has been preferred. However, it is the grievance of learned counsel for the Petitioner that despite making an attempt to move an application for hearing of the stay application, the Petitioner has been unsuccessful. It is requested that the application for stay be heard at the earliest by the AGRC.

Learned counsel for the Petitioner made some submissions on merits of the respective contentions. We have heard learned counsel for Respondent No.2. Learned counsel for the opposite faction orally submitted that he has been instructed to appear in the matter and intends to file an intervention application. We see no reason to entertain the oral request at this juncture.

In the facts and circumstances of the present case, this Petition can be disposed of by requesting the AGRC to decide the application for stay preferred by the Petitioner-Society expeditiously and in any case within a period of 4 weeks from the date, the AGRC holds the next hearing. It is open for the concerned parties to prefer appropriate application before the AGRC opposing the said request. 5.
