By order dated 11th April 2023, the Appeal filed by the Petitioners' vendor was partly allowed. The order passed by the SubDivisional Officer-Panvel dated 25th June 2020 was set aside. For the reasons mentioned in the order dated 11th April 2023, the SubDivisional Officer was directed to re-inquire into the matter and issue appropriate directions. It is the grievance that the Sub-Divisional Officer-Panvel has not complied with the order dated 11th April 2023 of the Additional Commissioner, Konkan Division. 1/3

We have heard learned AGP for the Respondent Nos.1 and 2State. It is the submission of learned counsel for the Petitioner that despite representations made to the Sub-Divisional Officer from time to time, no steps have been taken by the Sub-Divisional Officer. It need not be stated that the direction issued by the Additional Commissioner, Konkan Division have to be followed by the SubDivisional Officer-Panvel in its letter and spirit. Since the order is passed by the Additional Commissioner, Konkan Division, the Additional Commissioner, Konkan Division can also ensure compliance of its own orders by the Authorities to whom directions have been issued.

In any case, we direct the Sub-Divisional Officer-Panvel to ensure compliance of the order dated 11th April 2023 of the Additional Commissioner, Konkan Division expeditiously and in any case within a period of 8 weeks from the date of communication of this order, subject to any legal impediment.

The order dated 11th April 2023 which learned counsel for the Petitioner submits that inadvertently remained to be brought on record is taken on record. It is marked as Annexure-X for identification. 2/3

The Petition is disposed of accordingly.
