The petitioner bank is a secured creditor, and it is aggrieved by the fact that the Chief Judicial Magistrate, Esplanade, Mumbai has not decided an application filed by the petitioner under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest (SARFAESI) Act, 2002. 2.

It was brought to our notice that the application was filed on 21/11/2025 and it is still pending consideration. 3.

We find that the Magistrate in the present case has violated the directions issued by this Court in the case of 'L and T Finance Limited Vs. State of Maharashtra and Ors'1. In paragraph 23 (a) of the said judgement, this Court directed that such applications filed under Section 14 of the Securitisation Act shall be disposed of not later than 2023 SCC online Bom 931 varsha

Evidently, in the facts of the present case, the Magistrate has failed to abide by the directions issued by this Court. 5.

Hence, the Writ Petition is allowed and the Chief Judicial Magistrate, Esplanade, Mumbai, is directed to dispose of the application filed by the Petitioner-Bank under Section 14 of the Securitisation Act within 30 days from today. (SHREERAM V. SHIRSAT, J.) (MANISH PITALE, J.) varsha
