The petitioners are aggrieved by the refusal to grant interim relief during the pendency of the Revision in proceedings challenging the order under Section 154B-23, whereby the petitioners are disqualified for continuing as members of the managing committee, mainly on the ground that the petitioners have failed to comply with the order of the Registrar under Section 154B-8, directing them to hand over documents in relation to the general body meeting.

According to the petitioner, the petitioner has raised an arguable case of attempted compliance by furnishing documents as per the order under Section 154B-8. In my opinion therefore, the Revisional Authority ought to have protected the petitioner till disposal of the revision.

Hence, in my opinion, the order of disqualification under Section 154B-23 shall remain stayed till the disposal of the revision. The revision shall be disposed of within two weeks from 07 May 2026.

All contentions of both sides are kept open, which shall be decided in accordance with law.
