The Petitioner has filed the above Writ Petition challenging the order dated 30.04.2026 passed below Exhibit 131 in PA No. 727 of 2022 passed by the Family Court, Pune. 2.

By the order impugned, the Respondent-father has been granted overnight access of minor son Vihaan from 02.05.2026 at 11.00am to 07.05.2026 till 4.00pm. 3.

This Court, by order dated 02.05.2026 stayed the impugned order to the extent of allowing the Respondentfather to take child out of Pune to his native place during the 1/3

period from 04.05.2026 to 07.05.2026.

By consent of the parties, the following order is passed :

i) The respondent father shall pick-up the minor son Vihaan on 06.05.2026 at 11.00am in the presence of the Marriage Counsellor of Hon'ble Family Court, Pune. The Respondent- father shall return the custody of the son to the Petitionermother on 09.05.2026 at 4.00pm at the South Entrance gate of Pheonix Mall situated at Viman Nagar, Pune.

ii).

The Respondent further agrees and undertakes that he shall not remove the son Vihaan from the Pune jurisdiction during the said period. iii).

The Respondent- father in pursuance of the order dated 30.04.2026 passed on Exhibit 131 in PA No. 727 of 2022 has already deposited his passport in the Hon'ble Family Court, Pune and has filed his undertaking dated 02.05.2026 in PA No. 727 of 2022. It is agreed that in para 2 of the said 2/3

undertaking "07.05.2026 in the Court premises at about 04.00pm in presence of Marriage Counsellor" will be read as "on 09.05.2026 at 4.00pm at the South Entrance gate of Pheonix Mall situated at Viman Nagar, Pune.

iv).

The next date of hearing of PA No. 727 of 2022 before the Hon'ble family Court Pune is 06.05.2026, the parties by consent will adjourn the matter PA No. 727 of 2022 to 11.05.2026 to enable the Respondent to prefer an application for return of his passport deposited on 02.05.2026. The Respondent- father shall serve the copy of the said Application on the Petitioner's Advocate.

v).

All other terms and conditions of the impugned order dated 30.04.2026 passed on Exhibit 131 in PA No. 727 of 2022 shall continue. 5.
