P.C:- The petitioner, Abhay Mansukhlal Mehta, a Member of Videocon Co-operative Housing Society Ltd, has approached this Court raising a challenge to a Recovery Certificate issued in favour of the Co-operative Housing Society by the District Deputy Registrar Co-operative Societies by exercising the power under section 154B.
Parallelly, the petitioner has already approached the Deputy Registrar, Co-operative Societies by filing a complaint under section 78 of the Maharashtra Co-operative Societies Act, alleging that the Society has wrongly calculated the amount Tilak
2/2 45 WP 6199-26.doc and seeking the relief that an Administrator be appointed on the Society upon managing its day-to-day affairs. In light of the aforesaid two events, the petitioner seek a relief that his complaint filed in November 2023 before the Deputy Registrar shall be decided expeditiously and the order dated 29/7/2024 passed under Section 154(B) by Deputy Registrar Co-operative Societies, be stayed.
On hearing the learned counsel for the petitioner, and on perusal of the pleadings in the petition, we are of the view there is a remedy of Appeal available against the impugned order dated 29/7/2024, before the Registrar and hence, the petitioner is directed to avail the said remedy. As far as the complaint filed by the petitioner u/s.78 of the Maharashtra Co-operative Societies Act is concerned, if the same is not yet decided, we direct the Deputy Registrar, RSouth to expeditiously decide the said complaint. Petition stand disposed of.
