The present writ petition is completely misconceived. It is a settled position of law that a writ petition under Article 226 of the Constitution of India is not maintainable against a purely private agreement.

In the present case, the petitioner seeks to impugn an agreement executed between two private individuals, without involving any public duty or element of public law. 3.

In view thereof, the present Writ Petition cannot be entertained and the same stands dismissed.
