The writ petition being called on the production board, we have heard the counsel for the petitioners and the learned counsel representing the Recovery Officer.
Our attention is invited to the Recovery Certificate issued under Section 101 of the Maharashtra Co-operative Societies Act, 1960 in the sum of Rs.13,11,850/- in addition to the amount to be computed as interest at the rate of 15.50% on the principal amount. 1/3
The counsel for the petitioner has urged before us that the amount being insured a sum of approximately Rs.5,00,000/- has been received by the respondent No.2 but according to the learned counsel representing respondent Nos.2 and 4 the amount is being adjusted towards the interest amount and as on date according to him a sum of approximately Rs.12,00,000/- is due and payable by the petitioners. 2.
During the course of the day, we expect the counsel for the Patpedhi and the Special Recovery Officer to prepare the actual computation of the amount that was due and payable and what has been received and what is yet to be received. This computation shall be exchanged with the counsel for the petitioners who we expect to come up with a fair proposal by way of one time settlement and we expect the Patpedhi to consider the said proposal in a lienant manner. Since we are informed that the police protection is not made available, the process of taking over possession of the property of the petitioners is not likely to take place today and we direct that it shall not be done tomorrow i.e. 9th June 2026. 2/3
