Heard the learned Counsel for the Petitioner. 2.
A limited prayer in the Petition is to direct the learned Civil Judge, Pimpri, Pune, to proceed with RCS No.319 of 2016 as expeditiously as possible.

Learned Counsel for the Petitioner invited attention of the Court to an order dated 15 February 2026 passed by the learned Civil Judge which, inter alia, records that the cross-examination of the Plaintiffs' 4th witness was required to be deferred as a statement was made on behalf of the Plaintiffs that the Plaintiffs would file an application for transfer of the proceedings from the said Court. Learned Counsel for the Petitioners submits that since 16 February 2026, the suit has been adjourned on multiple occasions. According to his instructions, the Plaintiffs have yet not filed any transfer application. SSP 1/2
36 wp 7294 of 2026.doc However, in view of the statement made on behalf of the Plaintiffs that the Plaintiffs would file transfer application, the suit is not being proceeded with. 4.
If the Plaintiffs have yet not filed transfer application and there are no orders passed by the learned Principal District Judge staying the proceedings in RCS No.319 of 2016, there can be no impediment for the learned Civil Judge seized with RCS No.319 of 2016 to proceed with the hearing of the said suit.

Thus, the Writ Petition stands disposed with a request to the learned Civil Judge to hear and decide RCS No.319 of 2016 as expeditiously as possible, if there are no restraint orders passed by the superior Court.
