1) By this petition, Petitioner challenges order dated 29 May 2026 passed by the Maharashtra State Co-operative Appellate Court dismissing Appeal from Order No. 38 of 2026 and confirming order dated 7 May 2026 passed by the Learned Judge, Co-operative Court, Thane. By order dated 7 May 2026, the Co-operative Court rejected Petitioner's application at Exhibit-5 for temporary injunction. Petitioner had sought stay of implementation of Resolution adopted by the Managing 1 of
Committee of the society on 18 March 2026 nominating the Chairman as authorised representative of the Society to vote in the elections of Thane Palghar District Central Co-operative Bank.
2) I have heard Mr. Kulkarni, the learned counsel appearing for the Petitioner and Mr. Joshi, learned Advocate appearing for the Respondent.
3) It is seen that the only grievance of the Petitioner in respect of the Resolution adopted on 18 March 2026 by the Managing Committee of Respondent-Society is about non-receipt of Agenda of the Meeting 7 days in advance. There is no dispute to the position that Petitioner received notice in respect of the Meeting scheduled on 11 March 2026. He however complains that the Agenda for the meeting was received by him on 16 March 2018 i.e. 2 days prior to holding of the Meeting. In the meeting held on 18 March 2026, the Managing Committee has resolved to authorise the Chairman of the Respondent-Society to vote on behalf of the Society in the elections of Thane Palghar District Central Cooperative Bank. Upon being queried as to whether Petitioner was interested in the nomination as the authorised voter, the answer by Mr.
Kulkarni is in the negative. The elections of Thane Palghar District Central Co-operative Bank are scheduled to be held on 22 June 2026. Since Petitioner himself was never interested in nomination as authorised voter on behalf of the Respondent-Society, in my view, no purpose would be served by granting any temporary injunction in favour of the Petitioner.
Co-operative Court and Petitioner's Appeal from Order is rightly dismissed by the Appellate Court.
4) No interference is warranted in the impugned order. The Writ Petition is accordingly rejected.
