Heard the learned Counsel for the Petitioner. 2.

The Petitioner claims to be a member of the Trust - Shri Gorhekar Sanstha, Aalandi, and its former trustee. By an order dated 9 October 2024, in Suo-motu Inquiry No.5 of 2019, the learned Joint Charity Commissioner, Pune, has dismissed the trustees who were Respondent Nos.1 to 6 therein from the post of trustees, till the appointment of the legal trustees and the Inspector attached to the Office of the Charity Commissioner, has been appointed as an Administrator.

An application is preferred by the Petitioner seeking directions under Section 41A of the Maharashtra Public Trusts Act, 1950 seeking appointment of an Election Officer to hold the election of the Trust. The said application awaits adjudication.

Learned Counsel for the Petitioner invites attention of the Court to clause 9 of the Constitution of the Trust which, inter alia, provides that the election to the managing committee of the Trust would be held every three years in the annual general body meeting.

In view of the aforesaid mode of succession provided in the Constitution of the Trust and the fact that the learned Joint Charity Commissioner has appointed Inspector as an Administrator of the Trust, the learned Assistant Charity Commissioner is directed to hear and decide the application under Section 41A for appointment of an Election Officer for conducting election of the managing committee of the trust as expeditiously as possible.

The Writ Petition stands disposed.
