1) The petition challenges order dated 28 April 2016 passed by the Joint Registrar, Co-operative Societies, CIDCO, Navi Mumbai partly allowing Appeal No. 21/2025 and setting aside order dated 5 May 2025 passed by the Assistant Registrar. The Joint Registrar has merely remanded the proceedings for fresh determination by the Assistant Registrar. By order dated 5 May 2025, the Assistant Registrar had removed Respondent No.4 from the membership of the Society. It Page No.

Neeta Sawant 19-WP-7408-2026.docx appears that Respondent No.4 has functioned as Member of the Managing Committee for 10 long years and by order dated 5 May 2025, the Assistant Registrar directed his removal from membership of the Society. In view of this position, no interference is warranted in the impugned order which merely envisages remand of proceedings for fresh decision by the Assistant Registrar. The contention raised on behalf of the Petitioner that they were not heard by the Joint Registrar while passing order of remand does not appeal to this Court. It appears that two of the complainants/objectors were present before the Joint Registrar through their Advocate when the Appeal was heard. In any case, Petitioners can raise all objections relating to the membership of Respondent No.4 before the Assistant Registrar.

Considering the above position, I am not inclined to exercise extraordinary jurisdiction of this Court under Article 227 of the Constitution of India. 2) All rights and contentions of the parties on merits are expressly kept open to be agitated before the Assistant Registrar. The Writ Petition is accordingly disposed of.
