Mrs. Narwade, the learned counsel for the appellant submits that the limited grievance of the appellant in the present appeal is about mutation of the name of applicant - Shiraj as one of the legal heirs of deceased Zubeda who was granted 1/6th share in the ancestral property in the judgment and decree dated 1.3.2019 2.

The learned APP Mr. Patil, upon instructions from Mr. Sanjay Shinde, Tahsildar, Ahilyanagar who is present in the Court, has handed over the corrected 7 x 12 extract mutating the name of the present appellant as one of the legal heirs of Zubeda. The copy of the corrected 7 x 12 extract is taken on record and marked "X" for the purpose of identification.

The Tahsildar present in the Court assures that he shall take appropriate action to include the name of the applicant at the time of the execution of the decree of partition dated 1.3.2019, as one of the legal

{2} 21 sr.no...odt heirs of Zubedabi and allot the share. Thus, in view of the redressal of the grievance of the appellant, the learned counsel Mrs. Narwade, seeks permission to withdraw the appeal.

The Second Appeal is disposed of as withdrawn. Parties to act upon the revised mutation entries.
