By the impugned order, the Maharashtra Real Estate Appellate Tribunal ("the Appellate Tribunal") has directed the delivery of possession of the subject flat, subject to the outcome of the Appeal. 3.

During the pendency of Appeal before the Appellate Tribunal, there was no stay to the execution and operation of the order passed by the Authority directing the delivery of possession of the subject flat to ARS 1/2

The Appeal stands dismissed.
