The civil application is filed for condonation of delay of 82 days caused in filing the cross objection.

Perused the application and heard learned advocates for both sides. Learned advocate for respondent No.1 strongly opposed the application and submitted that there is no sufficient reason to condone the delay.

On perusal of application, it appears that the application was submitted when the notices of the appeal were received and therefore, delay is not deliberately caused. Considering the objections as well as the grounds raised in the application and the
ca464.26 -2period of delay is of 82 days only, it would be proper to condone the delay in the interest of justice as prayed for. Civil application is therefore, allowed in terms of prayer clause "B". 4.
In cross objection, issue notice to the respondents, returnable on 24.02.2026. Learned advocate Mr. Rathi, waives notice for respondent No.1. Learned advocate for the applicant to serve respondent No.2 by private notice, as is permissible in law. (SANJAY A. DESHMUKH, J.) rlj/
