Heard the parties.

Civil Application No. 2417 of 2026 is filed for withdrawal of amount deposited by the appellant/insurance company in the office of this Court pursuant to order passed by this Court on an interim application. The amount deposited is around of Rs.51,17,357/-.
( 2 ) Considering the arguments advanced by the parties, this court finds that the application needs to be partly allowed. Hence, following order:- 3.
The applicant Nos. 1, 2, 4 and 5 are permitted to withdraw 50% of the amount deposited in the office of this Court alongwith accrued interest on furnishing usual undertaking.

Further 25% of the amount is allowed to be withdrawn alongwith accrued interest on giving solvent surety/security to the satisfaction of the learned Registrar(Judicial) of this Court. 5.
Remaining 25% amount be kept in fixed deposit in any nationalized bank till final disposal of the appeal. 6.
So far as Applicant No.3 is concerned, she is a minor. She would be entitled to file application after she attained majority. Till then, the amount of interest accrued on the amount payable to her shall be credited to the account of applicant No.1.

With this, civil application stands disposed off. DELAY APPLICATION 8.

Civil Application No.595/2026 is filed for condonation of delay of
( 3 ) 46 days caused in filing the first appeal.

For the reason stated in the application, delay stands condoned. Application is allowed. Office to register first appeal. 11.
Civil application stands disposed off.
STAY APPLICATION 12.
Since the applicant/Insurance Company has already deposited the amount in the office of this Court as per impugned judgment and award passed by the trial Court alongwith interest, there shall be stay to the impugned judgment and award till final disposal of the appeal. 13.
