This is an application seeking withdrawal of the amount. Perused the application. Heard learned advocates for both sides. Learned advocate for the respondent strongly opposed the application.

Considering the peculiar facts of this case, the application deserves to be allowed partly. The application is thus partly allowed. The applicants are permitted to withdraw 75% of the amount with accrued interest thereon. Out of that, 50% amount be withdrawn on furnishing usual undertaking and 25% on execution of surety/security bond. It is clarified that the Tribunal shall not insist upon the valuation of the property from the Revenue authority.

The Registry is directed to transfer the amount, which is allowed to be withdrawn, to the Motor Accident Claims Tribunal, Shrirampur, Tq. Shrirampur, district Ahilyanagar. The Tribunal to pay the amount in the above terms.
