By this application, the Applicants seek issuance of notice to Respondent Nos. 2 and 3 through paper publication. 2.

In fact, Mr. R. F. Totala, learned Advocate for Respondent No. 1, submits that Respondent Nos. 2 and 3 have already been reported to be dead and the same has been recorded by this Court vide orders dated 18.07.2023 and 10.12.2025.

Ms. Sanghmitra Wadmare, learned Advocate for the Applicants submits that no death certificate has been placed on record by the learned Advocate for Respondent No.1.

Admittedly, the present matter is of the year 2023 and has been adjourned from time to time for various reasons. Therefore, I am inclined to allow the application in terms of prayer clause (B). 5.

Learned Advocate for the Applicants submits that there is no necessity of filing a separate application in the connected writ petition i.e. Writ Petition No.8394 of 223, as Respondent Nos.2 and 3 herein are Respondent Nos.4 and 5 in Writ Petition No. 8394 of 2023 and, therefore, the purpose would be served if the application filed in Writ Petition No.8449 of 2023 is allowed.

The notice shall indicate that the petition will be heard on 16.03.2026.
