First appeal has been disposed of vide common judgment and order dated 23rd December, 2025. At that time no order was passed in respect of disbursement of the amount lying with this Court with accrued interest.

It is brought to my notice that the acquiring body had deposited amount in this Court and out of that 75% amount was already disbursed to the applicants. The balance amount with accrued interest is still lying in this Court, which needs to be disbursed to the applicants.

It transpires from record that this Court enhanced the rate from Rs. 5,000/- per R to Rs. 8,000/- per R. The interest of the respondent acquiring body can be safeguarded in respect of clause D of the operative part of the judgment passed in first appeal while disbursing enhanced amount of compensation. The civil application is allowed in terms of prayer clauses 'A' and 'B'. The civil application is disposed of.
