Applicants seek to condone delay of 394 days caused in filing application for setting aside abatement and bringing the legal heirs of deceased Raosaheb Onkar Patil on record. 2.
The cause of action survives as against the legal heirs. There are no malafides on the part of the applicant. For the reasons stated in the application, the civil application is allowed in terms of prayer clauses B to D. The civil application is disposed of.
