Applicants seek to condone delay of 1522 days caused in filing civil application for setting aside abatement and bringing the legal heirs of deceased applicant Dadasaheb Eknath Sable - original claimant on record.

The cause of action survives against the legal heirs of deceased claimant. They are necessary parties. The delay cannot be said to be intentional. For the reasons stated in the application, the civil application is allowed. The delay stands condoned. The abatement, if any is set aside and leave is granted to bring the legal heirs of deceased Dadasaheb Eknath
