Present petition takes exception to order dated 06.12.2015 passed below Exhibit-1006 by Civil Judge Senior Division, Aurangabad in R.C.S. No.631/2019 (Old Special Civil Suit No.69/1972), whereby petitioner's application for setting aside no written statement order and acceptance of written statement has been rejected.

Heard learned advocates appearing for respective parties. 3.

It appears that State was added as party in suit in the year 2012. However, no written statement was filed and at this stage when matter reached for final hearing, application below Exhibit1006 was moved for setting aside no written statement order and acceptance of written statement.

Ms. Ansari, learned advocate appearing for respondent/legal heirs of original plaintiff, on instructions, states that plaintiffs have no objection if written statement filed by petitioner/State is taken on record.

In view of specific consent on behalf of plaintiffs, writ petition stands allowed in terms of prayer clause (B). 6.

Needless to state here that Trial Court shall endeavour to expeditiously decide suit in any case within a period of one year from today.

Parties shall co-operate for early disposal and shall not seek unnecessary adjournments.

Civil Application stands disposed of.
