This is the Application by the legal heirs of Deceased - Original Claimant, namely, Pelad Jemala Chavan for withdrawal of the amount deposited by the Acquriing Body under the Award. 2.

Heard both the sides.

The Special Land Acquisition Officer has determined rate of Rs.24,000/- per Hectare and the learned Reference Court has enhanced up to Rs.2,00,000/- per Hectare. The amount of enhanced compensation in the case at hand is Rs.2,50,000/-. The enhancement is approximately eight (8) times.

In view of the above, the following order is passed.

ORDER

(i) The Applicants are allowed to withdraw 75% amount under the Award along with interest accrued thereon on furnishing regular undertaking to the satisfaction of the learned Registrar (Judicial) of this Court.

(ii) Remaining 25% along with interest accrued thereon be invested in Fixed Deposit in any Nationalized Bank initially for two years, and if required, the same be renewed from time to time. (iii) Application stands disposed of accordingly.
