There is a delay of 2655 days in preferring the application and the reasons advanced is lack of knowledge regarding pendency of the proceeding. The learned counsel for the applicant has stated that most of the applicants are senior citizens and were not aware about the pendency of the Shrikant Malani

Considering the submissions made and the fact that the original appeal takes an exception to the judgment and award passed by the Reference Court, the present application is allowed in terms of prayer clauses (b), (c), and (d).
