This is an application for condonation of delay of 1024 days caused for filing the present application for setting aside abatement and bringing the legal representatives of the deceased applicant Laxman Vithal Puri on record.

Perused the application. Heard learned Advocates for both the sides.

Learned Advocate for the applicants submits that the claimants are poor and uneducated farmers. He submitted that if the delay is not condoned, claimants will be deprived of their rights. 4.

Learned AGP for respondent-State strongly opposed the application and submitted that the reasons stated in the application are not sufficient to condone the delay.

Upon perusal of the grounds of objection raised in the application, specifically in paragraph no.3, it appears that the claimants were not advised properly to prefer the application for bringing the legal representatives of deceased applicant on record within 90 days. The delay is not deliberately caused which reveals from the application. If the delay is not condoned, they will be deprived of their rights get enhanced amount of compensation. Therefore, as the delay is not deliberately caused, the application deserves to be allowed in the interest of justice. Hence, the following order:

ORDER

a.

Civil Application is allowed.

b.

Delay of 1024 days caused for filing the present application is condoned.

c.

Abatement is set aside.

d.

Applicants are permitted to bring the legal representatives of deceased applicant Laxman Vithal Puri on record.

e.

Applicants are directed to carry out the amendment forthwith.

f.

Civil Application is disposed of.
