Heard the learned Advocate for the applicant. 2.

This application is filed seeking restoration of the first appeal that came to be dismissed in view of the order dated 24.09.2024 passed by the learned Registrar (Judicial) of this Court. 3.

The appellant was directed to remove the office objections within two weeks. Since no office objections were removed, the petition came to be dismissed.

There is delay of 483 days caused in filing the present civil application. There was no notice to the other side before the rejection of the first appeal. Considering the above no notice is required. 5.

For the reasons stated in the application, delay stands condoned. Application is allowed. The order dated 24.09.2024 passed by the learned Registrar (Judicial) is set aside. Office to restore the first appeal to the original position subject to condition that the applicant shall remove all office objections within four weeks from today. 6.

It is made clear that the applicant shall also file affidavit that the appellant shall not be entitled to any interest or other statutory benefits for the period of delay.
