Applicants seek to condone delay of 400, 586 and 2151 days in setting aside abatement and bringing legal heirs of deceased applicants Aasaram Namdeo Maske, Gulab Maske and Sudam Bapurao Tanpure and on record in respective matters.

The cause of action survives as against the legal heirs of the deceased applicants. They are necessary parties. There is no reason to infer any malafides on the part of the applicants to cause delay. 3.

Civil applications are allowed accordingly.

It is clarified that in Civil Application No.1624 of 2026 heir No.1C Rambhau is dead and heir No.1D Aayodhya is his heir. 5.

Appellants/applicants shall be at liberty to carry out necessary amendment.
